夫妻忠实协议是婚姻法修改面临的重要问题之一,立法也经历了很大的曲折。在未来的立法当中,应当在婚姻法上增设关于夫妻忠实协议的具体条款,即确认夫妻忠实协议的效力应以离婚为前提,可以作为赔偿依据,并界定好其所应规制的具体事项范围和请求范围。

The agreement between husband and wife is an important issue that faces the revision of marriage law, the legislation of which also experiences lots of twists and turns. In the future legislation,specific items related with loyalty agreement between husband and wife should be added to the marriage law, that is to say, the effectiveness of such an agreement should be based on divorce, which will be regarded as compensation basis. The agreement should also clearly stipulate specific scope of items and request.
