农村土地经营权流转的现实困境与制度性原因分析

当前农地流转面临流转的非粮化非农化、流转中片面追求"快"和"大"、工商资本涌入的经营风险、基层政府介入集体土地经营权流转侵犯农民利益、土地经营权流转的市场化程度不高、农村土地流转行为不规范等现实困境。需要重新全面审视产权关系不明、集体经济组织定位不清、政府公共服务功能缺乏、制度性规范滞后等制约农村土地经营权流转的深层制度性原因,进而完善农村土地经营权流转中的相关土地产权规定,加强对行政权力的规范和监督,强化管理制度,加快劳动力转移步伐,完善各项农村就业和社会保障制度。

The real dilemma of current rural land transfer is reflected in the following aspects ： no food and ag- riculturalization of land transfer, the one - sided pursuit of ＂fast＂ and ＂ big＂ in the circulation ＂ , business risks of the influx of industrial and commercial capital, violations of the interests of farmers from grassroots government, the degree of marketization of rural land management right transfer and no standardized rural land transfer behavior. Therefore, it＇s important to review the deep institutional reasons of restricting rural land management right transfer, such as the unknown property rights relations, unclear orientation of collective eco- nomic organizations, the lack of effective supervision and the lack of government＇s public service function and the time lag of presenting the system specification. The breakthrough that we should emphases on in the next step of policy adjustment is to improve the relevant land property rights of rural land management right transfer, to strengthen the supervision and standardization of administrative power, to strengthen management system, to speed up the pace of labor transfer and to improve the rural employment and social security system.
