摘要
虚拟产权式商铺作为一种房地产经营模式很难在我国现有物权体系中找到其合理的法律定位。从现有立法中可以推导出虚拟产权式商铺购买人的权利限制原则。对于虚拟产权式商铺购买人拆分出租行为的法律评价,应当从分析其权利限制原则入手,对其权利行使超限与否进行具体分析。
As a real estate operation model, it is difficult right type shops in China' s current property right system. to find a reasonable legal position for virtual property We can deduce the principle that limits the right for the buyer of virtual property right type shops in existing legislation. As to the law - evaluation of buyer who split the rent, we should analyze its power by studying its power limit principle.
