摘要
基于信息不对称的考虑,《中华人民共和国消费者权益保护法》较为系统地规定了经营者的告知义务,从而保护处于信息弱势地位的消费者权益。第17号指导案例虽对适用《中华人民共和国消费者权益保护法》的惩罚性赔偿具有指导意义,但经营者告知义务的范围除免于告知的事项,需涵盖消费者的知情权内容,特殊事项应强制披露。此外,应站在社会整体利益的背景下界定经营者告知义务的范围和界限,不能盲目加重经营者的责任。
Based on the unbalanced information, Consumer Protection Law systematically stipulates the operator's obligation to inform, which protects the rights of consumers at disadvantage who lack market information .The guid-ance of Case No.17 guide the application for punitive damages of Consumer Protection Law, but the scope of the obligation of the business operator to inform the customers shall be disclosed, excluding the items that are not ex-empt from the matter, which shall cover the contents of the consumer's right to know.In addition, the scope and limits of the informing obligation should be defined under the background of the interests of the society as a whole in order to avoid the extra intended responsibilities of the operators.
