藏区赔命价习惯法与国家法的冲突与协调

On the Organic Combination of Tibetan Life Compensation and the Statutes

赔命价是人类社会早期盛行的一种以赔偿方式解决命案纠纷,并在受害人家属和侵害方之间达成和解的习俗。我国藏族地区赔命价的历史悠久,由于特殊的地理环境、宗教传统和民族心理等因素,赔命价习惯法在与国家法的博弈中,虽然处境尴尬却充满活力。司法部门的文件和田野调查资料显示赔命价习惯法与国家制定法之间存在一定的冲突,在现行政策和法律的框架范围内,摒弃赔命价习惯法的弊端,对其进行创造性转化,实现国家制定法与民族习惯法的协调,以发挥它在加强民族团结、维护社会稳定方面的积极作用。

There had been a popular custom of life compensation in early society,which the injuring party paid compensation to the injured party and then they came to a compromise. The customary law of life compensation has a long history and far-reaching influence in Tibet,owing to its unique social,cultural,religious and ethnic psychological reasons,although it reveals awkward in the game with the criminal statutes. The judicial documents and the field work data show that there is some tenses between the customary law and the criminal statutes. Within the framework of the current policy and law,the disadvantages of life compensation should be eliminated through creative transform and organic combination,so that it can improve national unity and social stability.
