摘要
不动产物权以登记生效为原则,以法律事实发生、确定为补充。确认物权归属的生效法律文书可以单方申请,认定物权转让合同效力未明确产权归属的,应当双方申请。登记机构根据生效法律文书登记的,对当事人不愿交回房屋权属证书的,还应当依法公告作废。
The real property registration follows the principle of registration effectiveness and occurrence and determination of legal facts as the supplement. The effective legal documents to confirm real right can be applied unilaterally; the cognizance of property transfer contract effectiveness without clear property ownership should be applied bilaterally. The registration abiding by the effective legal documents, if the parties are unwilling to return the house ownership certificate, shall be publicly declared invalid.
