摘要
人体基因是DNA分子上具有遗传信息的特定核苷酸序列。它与每一个个体都息息相关。目前对于人体基因的研究较多,但是对于人体基因在法律上的客体性质如何来界定还没有定论。本文在分析人体基因的基本生物学特征和作用的基础上着重分析人体基因研究的法律意义及人体基因的法律客体性质,认为在法律上人体基因不是一种物,也不是一般的隐私信息,而是自然人的最机密、最根本的人格信息。
Human gene is a DNA molecule with genetic information on the specific nucleotide sequence. It is closely related to each individual. There are many current researches on human genes,but how to define the object properties has not yet been determined for law. Based on the analysis of the basic biology of the human genes,the function of human gene researches is significant. People believe in law human genes is not a simple thing,but the most confidential information of a natural person.
