摘要
中国海事仲裁起步于20世纪50年代。虽然历经近60年的发展成绩斐然,但是中国海事仲裁依然没有引入在海事仲裁领域普遍流行的临时仲裁。临时仲裁在中国海事仲裁的缺失源于《中华人民共和国仲裁法》的制约。尽管如此,以中国海事仲裁委员会为代表的中国海事仲裁机构存在引入临时仲裁的可能。通过对临时仲裁的本质研究,试图在现有《中华人民共和国仲裁法》的制约下,分析论证通过中国海事仲裁机构的变革以引入临时仲裁的可能性,实现中国海事仲裁模式的创新。
China maritime arbitration started in the 1950s. However, after nearly 60 years of development, China has not yet introduced the widely accepted ad hoe arbitration in the field of maritime arbitration. The lack of ad hoe arbitration in China maritime arbitration is due to the restriction of the Arbitration Law of the People' s Republic of China. Nevertheless, represented by the China Maritime Arbitration Commission, there is a possibility that China maritime arbitration institutions would in- troduce the ad hoe arbitration. Through the study on the nature of the ad hoc arbitration and reform of the China maritime arbitration commission, the paper tried to analyze the possibility of the introduction of the ad hoc arbitration into the China Maritime Arbitration Commission under the restriction of the Arbitration Law of the People' s Republic of China, so as to achieve the innovation of the China maritime arbitration.
