浅谈企业合营行为的反垄断法规制──以欧盟竞争法为视角

Brief Introduction to the Anti-Monopoly Regulation of Enterprise Joint Behavior- From the Perspective of European Union Competition Law

企业合营由于其形态的多样性、行为的隐蔽性以及反竞争效果,许多国家对其进行反垄断法规制。本文对企业合营的限制竞争行为进行分析,以欧盟竞争法为视角,介绍欧盟的反垄断法规制企业合营行为的相关规定,结合我国目前的企业合营的反垄断规制上的缺陷,提出一些改善建议。

The joint venture of enterprises, due to its diversity, the concealment of its behavior and its an-ti-competitive effect, has taken the anti-monopoly regulation in many countries. This paper analyzes its restrict competition behavior, from the perspective of EU competition law, introduces related regulations, and puts forward some revision suggestions by combining with the existing defects in antitrust regulation in China.
