服务外包商业秘密保护权利义务主体的复杂多方性、保护内容的双向性,服务外包商业秘密立法、司法保护的不足,以及行政保护的诸多优势,使行政保护成为了服务外包商业秘密保护的客观要求。然而,现实中服务外包商业秘密行政保护存在诸多问题与不足。我们应通过提高服务外包商业秘密行政保护执法水平、建立健全服务外包商业秘密事前行政监管和事后追查机制以及加强行政主管部门对服务外包当事人商业秘密保护行政指导等来完善服务外包商业秘密的行政保护。

Administrative protection became the objective requirement for the protection of trade secrets in services outsourcing due to the complexity of the subject of right and obligation, the bidirection of the content of protection, the weak- ness of the legislative and judicial protection for the trade secrets in services outsourcing and the numerous superiority of the administrative protection. However, there are some problems and shortages in the administrative protection for trade secrets. We should average up the level of enforcing the law for protecting trade secrets in services outsoureing, found and perfect the beforehand administrative supervision and management and the subsequent tracking mechanism and strengthen the adminis- trative guidance from the competent department for the parties in services outsourcing in order to consummate the administrate protection for trade secrets in services outsourcing.
