摘要
根据建设用地现状,特殊土地权利人在拥有自身土地权利的同时,对相邻一定区域内建设用地的权利具有一定的限制要求,提出了在这一定的区域设立建设用地审议权和建设用地许可权,给出了定义,阐述了外延、内涵和特征;分析了建设用地审议权与许可权的异同点。这两项权利的设立既有法律依据,也有国家和地方法规条例作保障,既具可行性,现实中也有广泛实用性。
According to the status of construction land,special land owners have their special land rights.Mo-reover,there are certain limits in certain area for construction land rights.The establishment of deliberative right and permission in a certain area describes the extension,the connotation and characteristics.The similari-ties and differences between deliberative right and permission of construction land are proposed.The establish-ment of these two rights is based on laws,and in accordance with the state and local regulations.The rights are feasible,and has a wide range of practicality.
