摘要
体罚教育在道德上和法律上虽然受到谴责和否定,但体罚教育仍然是一种盛行的管教方式,其面临现实的情法困境,文章指出这些矛盾的表现,分析了情法困境背后的深层原因,进而讨论体罚教育的法理评析基础,指出以现代人权观视角,保护受教育者权利应作为一个整体的价值予以尊重和重视。
Though being blamed and denied because of the dilemma between morality and law in the real world,physical punish- ment is still a common schooling method. The thesis collects the contradictory phenomena, analyzes the deep causes behind them,discusses the basis of jurisprudential analysis, and finally points out that rights of the educated should be respected and valued as an entirety according to the modern viewpoint of human rights.
