摘要
本文论述了健康权的义务主体,探讨了国家是公民健康权的主义务主体源于健康权的性质和国家切实履行国际公约义务的必然要求,认为国家对公民健康权义务的种类可分为尊重的义务、保护的义务和给付的义务,且三种义务之间相辅相成、相互促进。国家不肯承担任何一种义务,公民都无法充分实现其健康权。
Besides countries,social organizations,enterprise organizations and government regulations,other citizens, and organs of United Nations are also the obligation body of citizens＇ health right,The paper discusses the obligation body of health right and analyzes the types of obligation of citizens＇ health right from countries that can be divided into obligation to respect,duty of protection and payment obligation.And the three obligations supplement and benefit each other. The citizens will not well realize their dream of health right ff countries do not undertake any kind of obligation.
