摘要
大学章程被视为大学"宪法"而具有最高效力,围绕章程展开的大学治理已经成为现代大学建设的重中之重。作为一种后赋权利,学术权利亟需在章程及其他具体规章制度中得以保护。本文通过实证考察六所大学的章程,剖析章程中关于学术权利规定的不足,并以章程为框架构建合理的学术权利保障体系。
Currently, the governance of universities depends on the establishment of regulations. Regulations are considered as the ＂constitution＂ of university and as the constitution it has the highest authority. University governance based on regulations has been the very key to build modern universities. Academic rights; as a post-granted fights, should be protected by university regulations and relevant specific rules. Through an empirical analysis of the six university regulations that has been approved, the current paper scrutinized the deficiency about academic rights protection, and proposed some strategies to establish scientific academic rights protection system for the well exercise of academic rights.
