What Kind of Legal Interpretation Do We Need? ——The fundamental of rules of statutory interpretation

法律解释规则旨在为解释要素的恰当运用提供指南。它在应用论和位序论两个层面上展开,同时处理解释要素的具体化和位序两个问题,由此构成一个完整的规则体系。在此基础上,法律解释规则不但为法律发现提供可操作指引,而且具有证立解释结论的功能,同时作为"专业语法",它还对法律解释共同体的思维建构起到积极作用。基于此,展开法律解释规则研究能够有效地回应"我们需要什么样的法律解释学"这一问题。

The rules of statutory interpretation spreads on the levels of apply and rank. Its aim is to resolve the application？ prob- lems about elements of statutory interpretation. It provides guide for law？ discovery, and justify the conclusion of statutory inter- pretation. Meanwhile, rules of statutory interpretation is the ＂grammar＂ of community of statutory interpretation, contribute to construct community of statutory interpretation. Based on this, the study of rules of statutory interpretation responds the question that what kind of legal interpretation do we need.
