农垦国有农地征收补偿问题探析

A Study on State- owned Farmland Expropriation and Compensation of the State Farms

经过多年改革,农垦国有农地使用权农地承包经营权已经成为用益物权,对其强制剥夺应纳入土地征收的范畴。在统一的土地征收制度下,因征收对象的不同,征收补偿的范围和标准有很大差别,应将农垦国有农地征收补偿纳入我国土地征收类型化立法中,以农地的经济价值、社会保障价值和生态价值为基础,拓宽农垦国有农地征收补偿的范围,提高农垦国有农地征收补偿的标准,给予相关权利人以公平合理的补偿。

After years of reform, both the land - use right and the contractual right of state farms＇ state - owned land have become usufructuary rights, therefore, the compulsory deprivation of it should be included in the scope of land expropriation. In the uni- fied land expropriation system, the compensation scopes and standards differ widely due to the different objects. Accordingly, the state - owned farmland expropriation and compensation should be legislated on the types. What＇ s more, based on the farmland＇ s economic value, social security value and ecological value, we should broaden the scope of the state - owned farmland expropriation and compensation, improve the standards of expropriation and compensation and provide fair and reasonable compensation to related obligees.
