摘要
在城镇化进程中,宅基地退出并复垦有着积极的现实意义。但实践中大部分地区的农民对宅基地退出仍持消极态度。当前宅基地退出中缺少对土地发展权的经济补偿,正是宅基地退出难以有效开展的根源。新增建设用地指标的异地使用正是复垦宅基地上发展权的异地流转,确立农民及集体对新增建设用地指标的支配权,既为宅基地退出补偿机制的合法化所需,也是宅基地退出激励机制的有效方式。
During the urbanization process,the homestead's exit and reclamation plays a positive role.The peasants in most areas still assume a passive attitude toward the exit of the homestead. From the perspective of the change of the peasants' right in land,this article,on one hand,analyzes the existence and disappear of land development right in land recultivated; On the other hand,discusses that the peasants and the collectivity should be entitled to the land development right and points out the lack of economic compensation for land development right in land reclamation make it hard to carry out the exit of the homestead effectively.This article analyzes the generation and nature of the newly increased constructive land index,points out that the newly increased constructive land index's off- site use makes the off- site transfer of the land recultivated,and establishes the peasant and the collectivity's right to dispose of the newly increased constructive land index,which is needed for the legalization of the compensation mechanism for the exit of the homestead,and is the effective way for the exit incentive mechanism.
