摘要
2011年3月15日,刘心武、郭敬明等50位作家集体发表《中国作家声讨百度书》,强烈反对百度文库在未经以上著作权人的同意下收录了他们大部分的作品,并向网民免费开放,提供免费文档作品的下载行为。百度文库于次日对此事作出相关回应,声称自百度文库诞生之日起就已郑重承诺,若文库用户上传的内容存在侵权,作者与版权方可向百度文库进行投诉,告知相关情况,百度会在48小时内进行核实并根据相关法律规定作出相应处理。2012年9月17日,北京市海淀区人民法院对作家维权联盟状告百度文库侵权案作出一审判决,判令百度公司构成侵权,需赔偿包括韩寒在内的3名作家经济损失共计14.5万元,但关闭百度文库的请求被驳回。尽管该案已尘埃落定,但该案所引发的如何完善避风港原则在网络版权保护司法实践中的运用,是摆在司法者面前一个亟待解决的问题,值得我们去探析,本文拟从该原则在司法实践中遇到的问题入手,寻求解决方法,希望能对相关法律制度的进一步完善提出有用的建议。
On March 15,2011,over fifty authors including Liu Xinwu and Guo Jingming together issued the Denunciation Letter on Baidu by Chinese writers.They strongly oppose the collection of most of their works on Baidu Wenku without the agreement of the author and offered free documents for the downloading of their works.The next day,Baidu Wenku responded to this incident and proclaimed that ever since its birth it had solemnly promised that if the uploaded content of the Baidu Wenku had any infringement,the author and the copyrighter could complaint to Baidu Wenku and provided relevant information and Baidu Wenku would review the situation within 48 hours and handle the situation according to laws and regulations.On September 17,2012,The People's Court of Haidian District made the first judgment on this infringement case by Baidu Wenku from the complaint of author right upholding alliance,judging that the Baidu had infringed upon their rights and should compensate for the economic losses of 145,000 to the three authors including Han Han but the request to ban Baidu Wenku was rejected.Although this case was already concluded,it has become a practical issue in front of the judiciary as to how to adopt the principle of harbor in the practice of judiciary protection over online copyright.This issue deserves our study and exploration.This paper starts from the problems met in the judiciary practice,seeks for solutions and hopes to provide useful suggestions for further improvement of relevant laws and regulations.
