With the completion of the Human Genome Project, gene diagnosis and treatment has be- come a new bio-medical technology. Gene diagnosis and treatment is one of the most popular bio-med- ical industries, but granting a patent on the gene diagnosis and treatment is on discussion. This paper introduced the practice about the gene diagnosis and treatment in America, Europe and Japan, and e- laborated the reasons for and against the patentability of gene diagnosis and treatment, and at the end the comments were put forward.
