摘要
工伤保险制度基于雇主责任保险,既不同于商业保险,更有别于民事赔偿,只要用人单位不是有意延迟或不申报,提出合情合理的"特殊情况",而社会保险部门没有与用人单位提出的"特殊情况"相背的证明材料,应受理用人单位延迟的工伤认定申请。
Industrial injury insurance system is different from commercial insurance, and more different from civil compensation. As long as the employers did not intentionally delay or refuse reporting, for the reasonable "special case", the social insurance department did not has evidence to oppose the employers' application of "special case", shall the delayed application be accepted.
