摘要
忠诚协议这一现象在现代社会已是常见,现行法律却未对其进行明确规定,导致司法实践存在较大分歧。夫妻忠诚协议应受到法律调整,在法律适用上对认定夫妻忠诚协议的必要性与效力应采取多维度的视野,司法实践则应对忠诚协议予以相应法律指导以保障当事人权益。
The loyalty agreements of marriage should be adjusted legally,and its necessity and effectiveness should be identified from the perspective of multidimensional in the application of law.Moreover,specific provisions on loyalty agreements should be made in terms of law,and corresponding legal guidance should also be given in the judicial practice in order to guarantee legal rights of interest-ed parties.
