摘要
随着我国不动产登记统一立法工作的开展,如何确定业主共有部分并办理相应的登记是非常重要的问题。《物权法》对业主共有部分的范围作出了一些规定。这些规定使得建筑区划内的道路、绿地、物业服务用房、车位、车库和会所的归属变得更加清晰,有利于在不动产登记簿上进行相应的记载。不动产登记簿上应当对属于全体业主共有的不动产进行登记,申请的主体是房地产开发企业或其他建设单位,由它们在办理房屋所有权初始登记时一并申请。
China is carrying out the legislation of unified real estate registration,it is very important to determine the common ownership parts and the corresponding registration.The Property Law of PRC provides for the scope of common ownership parts of the proprietors.These provisions make much clearer the belonging of roads,green spaces,houses or rooms used for property management,parking spaces,garages and the home clubs within the building areas.It is useful for the corresponding registration in the real estate registry.The real property belonging to all the owners should be recorded in the real estate register books.The primary applicants for the registry are the real estate development enterprises or other construction units,who apply for the registration of these common ownership parts together with the initial registration in dealing with the ownership of the buildings.
