云计算对司法审判的可能性渗透 被引量:1

Probable Permeability of Cloud-Computing on Judicial Trials

摘要 云计算作为一项新型的信息技术,已逐渐渗透到各个领域,给各个领域带来全新、高效的模式。那么,亦可初步构想将云计算引入司法审判领域进行交叉研究。通过专家请教,实验室模拟等方法,初步探索其可能在司法审判中应用的具体领域为审判管理、远程审判、审判公开等,并进一步探讨了云计算在渗透中可能会遭遇云计算技术高端且多变特性的挑战,面临云计算应用转化的难度攻关以及存在云计算的安全风险隐患等障碍。这需要法学研究者和云计算专家共同齐心合力进一步地深入研究和摸索实践,以达到创新司法审判模式和管理,最大程度地保证司法公正、司法独立、司法公开,进而推进以审判为中心的诉讼制度改革并最终契合法律效果与社会效果的统一这一目标精神。 Cloud-computing is known as a brand-new information technology,has gradually permeated to each domain that has brought a new efficient into the pattern.Therefore,the cloud-computing concept can also be introduced Into the studying of justice and cross-fields.Through the expert advices,laboratory simulation methods,it explores the specific areas of its possible application in the judicial trial to trial management,remote trial,public trial,furthermore,it discussed the challenges of the cloud-computing in permeability may encounter the cloud-computing technology in high-end and variable characteristics,potential risks of the cloud-computing application transformation key and difficulty of cloud-computing which includes other obstacles will also be faced.The further studying and practice of law researchers and cloud computing will be required by the experts in terms of making concerted efforts,in order to achieve the innovation of judicial mode and management,to ensure maximizing and promoting judicial justice,judicial independence,judicial disclosure that can fit the unification of legal effects and social effects of the mission objective eventually.
