论知情权与隐私权的冲突与协调

On the Conflict and Balance of Right to Information and Privacy

知情权与隐私权都应是自然人所具有的权利。在法制社会,人人都享有平等的权利。行使权利的前提,必须要有"知"的权利,并有权获得其所想要"知"的权利,这就涉及知情权。随着社会的快速发展,传媒手段的多样化,获取信息的渠道不再单一,尤其是随着网络技术的发展,信息实现了快速而全方位的共享,这就为知情权的享有提供了充分的条件。但是,另一个不可忽视的问题是,在人们充分享有获得信息的权利的同时,一些个人所享有的,却不愿为外人所知的信息也被传播与宣扬,这就涉及了隐私权。一方面,人们要求知道自己应当知道的一切,另一方面,又不愿公开自己的私人信息,而这两者都是应当正当享有的权利,这就不可避免地发生了冲突,需要实践加以协调。文章包括四个部分,首先通过一个案例对知情权与隐私权进行概述;其次简述我国法律对知情权与隐私权进行的保护;再次分析知情权与隐私权在社会中的冲突形态;最后阐述知情权与隐私权在实践中的协调。

Privacy and right to information is the right which a natural person has.The rule of law in society is that everyone fully enjoys equal rights.The exercise of right must be the premise of＂know＂the right to get what he wants,the right to＂know＂the right,which is the right to know.With the rapid socio-economic development of mass media means of diversification,access to information channels are no longer single,especially with the development of the full enjoyment of the right to know the conditions.However,another problem may not be ignored：in the full enjoyment of access to information,the information some individuals own without wantinng to be shared was promoted and disseminated,which is related to privacy.On the one hand people demand to know everything they have right to know;on the other hand they do not want to disclose their own private information.Both of the legitimate rights caused inevitable conflict,which need to be coordinated in practice.This paper consists of four parts.First,it is an overview of the privacy and right to information on the base of a case.Second,it puts the law to the protection of privacy and right to information in a nutshell.Third,it introduces the conflict forms of privacy and right to information in the social reality.Finally,it is an analysis of the balance of privacy and right to information in practice.In short,this paper is on the basis of analysis of more and more cases of the conflict between them to find the source of the conflict and balance in practice to implement the rights.
