打击跨境有组织犯罪区际警务合作制度研究

A Study on the System of Regional Police Cooperation of Combating Transnational Organized Crime

随着全球政治、经济、文化一体化进程的不断深入,有组织犯罪也呈现出跨国、跨境的趋势,并利用不同国家间、不同法域间的立法、司法的差异与冲突逃避打击。尽管两岸四地警方不断探索打击跨境有组织犯罪警务合作的途径,但是,由于四法域间具有不同的法律制度,在许多方面的合作仍不尽理想。如何在"三法系四法域"的背景下,建立科学有效的区际警务合作制度应是理论与实践研究的必然。

With the deepening of the integration process of global politics, economy and culture, organized crime presents a tendency of cross - border. The offenders often take advantage of the legislative or judicial differences and conflicts of different countries or jurisdictions in order to evade the legal sanction. Although the police of Hong Kong, Macao and the two sides of the Strait have been exploring the cooperative ways to combat transnational organized crime, the police cooperation is still not so perfect in many aspects because of the different legal systems among the four legal scopes of China. Therefore, under the background of ＂One Country, Two Systems, Three Jurisdictions and Four Legal Scopes＂, how to establish a scientific and effective system of regional police cooperation shall be the inevitable way of the study and practice.
