摘要
新行政诉讼法对复议机关作为被告情形进行完善,但有可能导致和助长复议机关不受理复议案件或受理后倾向于不作为的危险,还存在复议机关作出维持决定时造成法院级别管辖上的困境。对此,本着充分发挥行政复议制度效用的目的,对复议机关以不符合受理条件为由而不受理或受理后不作为的情形,都要将复议机关作为被告来对待,以促使其积极履行复议职责,及时解决行政争议。当复议机关与原行政机关被当作共同被告的情形下,如果出现行政诉级别管辖上的冲突,应以级别高的法院管辖为原则。
The content about the defendant of administrative reconsideration body has been modified and improved in new administrative procedure law. But there exist new problems which the administrative reconsideration body may not accept the reconsideration cases or don' t make reconsid- eration decisions on time, and the plight of the jurisdiction of the court. For this purpose of giving full play to the administrative reconsideration system, the administrative reconsideration bodies should be listed as the defendant to promote their positive reconsideration and resolution of adminis- trative disputes timely when they may not accept the reconsideration cases or don' t make reconsider- ation decisions on time. High level courts should exercise jurisdiction over such cases of co-defend- ants, if there is a conflict of administrative litigation jurisdiction.
