《气候变化应对法》制定时如何规定公众参与?(上)

法律的实施离不开公众的支持,如何引导公众有序、有效参与应对气候变化,是《气候变化应对法》制定时应当考虑的问题。目前,各界在《气候变化应对法》的立法定位,气候变化应对中公众参与的必要性,气候变化应对立法中的公众概念,气候变化应对中公众参与的情形、方式、环节、程序和保障,碳排放交易市场的公众参与,气候变化应对的公益诉讼,公众参与气候变化应对的法律体系建设,公众参与气候变化应对的法律规定方式等方面,既存在某些共识,也存在一定分歧,值得制定《气候变化应对法》时参考和借鉴。科学、全面、合理、可操作的体制制度和机制设计,有利于发挥公众的法治主体地位,壮大应对气候变化的力量,形成政府、社会、市场参与气候变化的平衡格局,促进三方良性互动。

The enactment and enforcement of laws can not be done perfectly without public＇ s support. How to enhance public participation should be considered in the enactment of the Law on Coping with Climate Change. Now there are both consensus and disagreement in areas of the necessity of public participation in coping with climate change, the notion of public, the scenario, manner, stage, procedure and guarantee of public participation, public interest litigation, public participation in carbon emission trade, the public participation in legal system construction, and the legal statement of public participation in the climate change fighting. We should take all these ideas into consideration. A scientific, comprehensive, proper and practical system and mechanism is good for building power in fighting climate change, making the public the legal main body, and forming a balanced pattern among government, society and market in coping with climate change.
