论我国公益诉讼诉讼费用制度的完善——以诉讼费用负担为视角

Improvement of Public Interest Litigation Costs System in China——In the perspective of costs burden

我国在2012年新修改的民事诉讼法中正式确立了公益诉讼制度,但该制度在实践中没有充分发挥其作用,为了实现公益诉讼的立法目的,必须对现有的诉讼费用制度进行改革。从费用负担的角度来看,必须构建国家和当事人以及当事人之间两个层次的费用负担体系,在纵向上应当坚持国家和社会分担的原则,在横向上侧重保护原告。

The public interest litigation has been set in the revised civil procedure law in 2012,but it does not fully play its role in judicial practice. So in order to achieve the purpose of public interest litigation,we must reform the existing litigation costs system. In the perspective of costs burden,the costs burden system should be built on two levels. On one hand,between the country and the party,the state and the society must share the costs. On the other hand,between the parties,we should focus on protecting the accuser.
