Connotation of Common-law Constitutionalism and Its Revival——A Discussion on James Tully's View of Constitutionalism

普通法宪政主义是当代宪政主义被遮蔽的一个面向,由于长期以来现代宪政主义的话语独霸,无论是西方还是中国对于它的关注和探讨都显不够。本文意图在与现代宪政主义的对比中概括普通法宪政主义的内涵并分析塔利以普通法宪政主义解决当代"承认的政治"的思路与意义。

Common-law constitutionalism is an obscured face of contemporary constitutionalism. Due to the ＂discourse hegemony＂ of modern constitutionalism, the attention and discussion on it are not enough whether in western countries or in China. The intention of this article is to generalize the connotation of common-law constitutionalism based on the comparison with modern constitutionalism and analyze the thought and meaning of James Tully＇s response to contemporary ＂recognized politics ＂ with common-law constitutionalism.
