摘要
2015年3月1日《不动产登记暂行条例》正式实施,其第五条前九款列举了需要登记的九项不动产权利,这基本保证了不动产登记权利类型的统一,同时在第十款规定了一项兜底条款,即"法律规定需要登记的其他不动产权利",这为取水权纳入不动产登记提供了法律空间。取水权作为一项特殊的不动产物权,具有较强的排他效力和优先效力,然而由于其客体的特殊性,取水权的权利效力难以在现行法律制度下得到较完善的保护,将取水权纳入不动产登记具有紧迫的必要性。
On March 1, 2015, the official implementation of "Provisional Regulations on Real Estate registration" was implemented, and the first nine paragraphs of Article Five list nine real property rights required to be registered, which is essential to ensure that the type of real estate registration is unified. While the tenth paragraph issues a save clause stating that "there're other real estate rights needs to be registered by law", which includes the water-drawing rights. As a special real property, water-drawing rights have got characteristics of exclusive efficacy and prefer efficiency, but it can't get better protection easily under the existing legal system because its peculiarity. Thus, it urgent to include water-drawing rights into real property registration.
