探究网络涉毒行为的实务问题及刑法的应对

近年来,随着互联网技术的不断发展以及公安机关对毒品严厉打击的高压态势,传统的毒品犯罪另辟蹊径,依靠互联网技术有了新的发展。但是,随着网络毒品违法犯罪的时代演变,我国刑法分则的规定显得有点滞后。为了使我国刑法分则体系在信息化时代适用网络涉毒行为的要求,出台相关立法和新司法解释是解决问题的关键。特别需要对我国有关毒品犯罪的某些"关键词"作扩张解释,对某些刑法尚未规定为犯罪的行为但依靠网络平台足以达到严重危害社会的行为建议设立新类型犯罪,对在网络空间下涉毒犯罪行为存在的定罪模糊、量刑欠佳状况予以明确。以此实现刑法分则应对网络涉毒行为的转型,避免放纵犯罪。

In recent years, with the continuous development of Internet technology and the high - pressure situation of cracking down on drugs by public security organs, the traditional path of drug crime, relying on the Internet technology takes on a new trend. However, the provisions of the Criminal Law of China lag behind the evolution of drugrelated crimes. In order to enable China＇ s criminal law system in the information age to meet requirements of online drug - related behaviors, relevant legislations and judicial interpretations are the keys to solve the problems. Especially extensive interpretations about some key words of crimes related to drugs are required; some criminal behaviors, which are not stipu- lated in the criminal law, shall be considered new crimes for doing serious harm to the society through the online platform; the fuzzy conviction of drug - related crimes in cyberspace and the poorsentencing conditions shall be clarified. Transformation of the criminal law in response online drug- related behaviors will help avoid indulging crimes.
