摘要
公私合力是近年来政府寻求提升社会治理能力,改善治理效果的主流思维,同时也被视为一项重要的政府改革措施。在公私合力的治理中,私部门承担部分行政任务,传统的行政程序规范和限制的只能是公权力的行使,而私部门完成行政任务时的行为纳入行政程序的规制中已成为现代行政程序法发展的必然趋势,从而必将导致公私合力背景下行政程序的主体权利、内容等相应地发生变化与革新。因此,从行政法理论层面上,有必要对公私合力作一明确的法律定位,进而对公私合力背景下的行政程序走向予以重新思考与规划。在此思维框架下,应探究行政程序变革的必然性,思考如何培育和拓展更为合适的私部门来配合公部门有效地完成行政任务,构建适合公私合力高效完成行政任务的良性行政程序制度环境。
In recent years,public-private cooperation has been a mainstream thinking that the government seeks to enhance the social governance capacity and improve the governance effect,which at the same time,also is regarded as an important government reform measure.In the governance of public-private cooperation,the private sector undertakes part of the administrative tasks,and the traditional administrative procedures regulate and limit only public power.However,that the behavior should be taken into the regulation of administrative procedure when the private sector completes administrative tasks has been an inevitable trend of the development of modern administrative procedure law,which will accordingly lead to administrative procedure rights and contents' changes and innovation in the background of public-private cooperation.Therefore,from the aspect of theory in administrative law,it is necessary to definite the legal position of the public-private cooperation and then to rethink and plan the trend of administrative procedure under the background of public-private cooperation.Adopting this framework,the author attempts to study the necessity of the administrative procedure reform,explore how to complete an administrative task by cultivating and developing a more suitable private sector to adjust to the public sector,and try to design a sound administrative procedure system to achieve an effective cooperation between private force and public one.
