当前新疆高校制定大学章程应注意的正当程序——以新疆师范大学章程为例

On the College Statutes Making Procedure in Colleges and Universities in Xinjiang at Present——A Case Study of Xinjiang Normal University

大学章程是学校依法治校、自主发展的必然要求,是现代大学制度的具体体现。只有正当程序才能有效保证大学章程的合法性与完整性,才能使得章程的效力更好地发挥。根据《高等学校章程制定暂行办法》,新疆高校要通过正当程序来制定和完善大学章程,并且在章程中明确规定程序性条款,维护章程作为"大学宪法"的最高权威。

The statute of university is the necessity of running university in accordance with the law and its independent development. The legitimate procedure can not only guarantee the validity and integrity of college statutes but also improve its effectiveness of implementation. According to ＂ the Interim Procedure of College Statues Making＂ the constitutes making and amending of Xinjiang colleges should follow the legitimate procedure and the definite procedural provision should be added so as to maintain the college statutes as the absolute authority in colleges and universities.
