群体性事件中的聚众犯罪防控对策研究

社会深刻转型,各种矛盾叠加共振,群体性事件层出不穷,特别是价值观追求型和社会泄愤型群体性事件极易引发聚众犯罪。究其原因,主要是深层次矛盾愈发尖锐、利益表达与协商机制失灵、政府公信力下降等社会因素与各种不良社会心态为主的个人因素的相互作用。在群体性事件视野下防控聚众犯罪,其根本方向是建立社会矛盾化解机制,其着眼点是控制群体性事件的冲突程度,其关键点是建立规则和程序,开启群体性事件的"法治化"进程,规范公权力的行使。

as the profound social transformation,various contradictions superposition and resonance,mass incidents emerge in an endless stream,especially the value pursuit and social anger discharging type of mass incidents is extremely easy to cause the mob crime. The main reason is the interaction of deep- seated contradictions increasingly sharp,interest expression and negotiation mechanism failure,the credibility of the government decreased social factors and the personal factors based of social unhealthy mentality. To prevent and control of the mob crime from the perspective of the mass incidents,its basic direction is to establish a mechanism to resolve social contradictions,its starting point is to control the degree of conflict of mass incidents,the key point is to establish rules and procedures,open the ＂rule of law＂process of group incidents,standardizing the exercise of public power.
