摘要
新一轮土地改革能否取得成功的关键,在于能否实现征地范围的有效缩小。从提高土地的节约集约利用、有效增加建地供应量的角度讲,应制定用地效率强制标准,构建强制征购收回多余土地的制度。从公共利益的界定、切割经营性征收的角度讲,应破除"由政府组织实施"即为公益需要的魔咒,制定《土地征收目录》。从提高征地补偿标准、打破地方政府土地财政依赖的角度讲,应改革补偿定价方式,构建起某些财政利益代偿机制。各项改革举措的实施,应配套联动进行。
The key to success with respect to the new round of land reform lies in the success to narrow the range of land acquisition. From a certain perspective of improving conservation and intensive use of land and effectively increasing the supply of construction land,mandatory efficiency standards and compulsory acquisition system to recover the excess land should be developed. From the perspective of the definition of the public interest and cutting off operating levy,legislation should get rid of "implemented by the government organization"curse and develop "land expropriation directory. "From the perspective of improving land requisition compensation standards and breaking local governments rely on land finance,compensation pricing mechanism should be reformed,and some financial benefits of compensatory mechanisms should be built. Implementation of all reform initiatives should make supporting linkage.
