法治反腐的制度体系及其建构

The Construction of Anti-corruption System with the Rule of Law

法治反腐的关键是要形成系统化、规范化的制度体系。当前我国初步形成了以党内法规与国家立法为框架的腐败治理制度体系,但还存在着一些缺陷,影响了法治反腐的实际效应。建构和完善腐败治理制度体系重点是要创新反腐败立法理念,制定统一的国家反腐败法,完善相关配套法规,推进反腐败立法的地方先行、国际合作以及对网络等新型反腐形式的立法规制。

The key of anti-corruption with the rule of law is to formulate systematic and standardized mechanism. Currently in China, the corruption governance mechanism mainly incorporates inner Party disciplines and national legislations, which still has some flaws that have impacts on the practical effect of anti-corruption with the rule of law. The priority of formulating and improving the anti-corruption mechanism is to innovate on the concept of anti-corruption legislation, so as to draft unified National Anti-corruption Law, improve relevant implementing regulations, and promote legislative practices such as local anti-corruption legislation goes first, international cooperative anti-corruption, and new-type of anti-corruption legislations such as network anticorruption.
