产权式酒店最初在海南兴起。作为一种在九十年代兴起的产品,产权式酒店在我国的发展不过十几年,其所涉及的当事方可以分为开发商、客房产权人以及酒店管理者。产权式酒店中基于三方当事人产生了纷繁复杂的法律关系,其中包括物权法律关系与合同法律关系。然而,由于发展时间较短,产权式酒店也出现了诸多争议。本文集中探讨的是产权式酒店中的合同法律关系。

The property right hotel first arose in Hainan province. As a new product the 1990 s,it has developed for more than ten years in China,the parties involved can be divided into developers,property owner and hotel managers. There are complicated legal relations based on the three parties in property right hotel,including the real right legal relation and contract legal relation. However,due to its short development,there are also lots of controversies in it. In this paper,the legal relation of contract was paid much attention to.
