贪污受贿犯罪是人类社会的通病,近年来,贪污受贿案件频频曝光。同"低成本、高收益"的贪污受贿行为相比,我国目前的反贪污受贿却陷入"高投入、低收益"的困境,这不得不引起我们的关注。刑法的经济分析是指运用经济学的基本理论和方法对刑法进行研究,探寻刑法成本最小化和刑法效益最大化的一种方法。运用经济分析的方法可以让我们更好地认识贪污受贿犯罪的成因,反贪污受贿犯罪的必要性,以期有更好的方法防范和控制贪污腐败犯罪的发生。

The crime of corruption and bribery is common for human society. In recent years,corruption and bribery cases were frequently exposed,and the government has also invested a lot of man powers and resources,including all aspects of social support. Compared with the corruption and bribery of low cost and high profit,the anti-corruption measures are stepping into a situation of high investment and low profit,on which attentions should be focused. The economic analysis of criminal law refers to the use of the basic theories and methods of economics,applying the economic analysis method to study the criminal law,to explore a method to study the maximum criminal law of minimum cost and efficiency of the criminal law. By using economic analysis,we will better know the causes of the corruption and bribery crime,the necessity of anti-corruption and bribery crime,in order to have a better method to prevent and control the occurrence of corruption crime.
