随着个体崛起,传统家庭伦理道德对个体的影响和约束不断减弱。在尚未完全解体的家产制实践面前,作为独立个体的家庭成员之间的利益争夺和权利诉求常常引发家庭内部的矛盾和冲突。为改变这种状况,首先,应当在伦理和道德层面重新发现和确认家庭的价值,重视家庭道德对个体的积极影响,并在此基础上对个体主义的盲目扩张进行一定程度的限制;其次,考虑到城乡社会变迁和人口流动的社会现实,应当更多考虑产权明晰的重要性,以保证个人权利的有序实现。法律应当为家庭和睦与个人权利的实现提供整体性的指引和保障。

With the rise of individualism, individuals bound by traditional family ethnic less then before. In front of the Family Property System which had not completely disintegrated, the family is full of conflicts and contradictions because of the struggle between different family members for there interests. In order to change this situation, first, We have to find and confirm the value of family, and emphasize the positive influence of family morality on the individual.We also have to constrain the expansion of individualism in a certain extent. Secondly, considering the social reality of social changes and population mobility, we should give more consideration to the importance of property rights, and ensure the rights of individuals to achieve in good order. Legislation should provide integral protection for the family harmony and individual rights.
