摘要 结合张伟锋诉3M职务发明报酬纠纷诉讼案例,针对包括跨国公司在内的国内外之企业集团"中央集权"知识产权管理模式下的职务发明报酬系列问题进行探析,可以发现:跨国公司"中央集权"知识产权管理模式下,跨境共同完成并授予了中国专利权的职务发明报酬纠纷应当适用我国专利法等职务报酬法律规范;在企业集团"中央集权"知识产权管理模式下支付职务发明报酬的责任主体,应当"揭开公司的面纱"由企业集团整体承担并由企业集团相关成员负连带责任;在企业集团"中央集权"知识产权管理模式下的职务发明报酬纠纷乃至于诉讼中,职务发明报酬金额计算与确定的举证责任应当合理分配,应当加重更多掌握相关信息和资料的企业集团一方的举证责任。 The thesis analysis a series of problem in the enterprise group included transnational employee's invention remuneration, that with IP Centralization management, as Zhang Weifeng sued 3M for remuneration of employee invention. The thesis has three conclusions: I. As the IP Centralization management, the employee's invention remuneration dispute that transnational corporation cross-border cooperation and awarded china patent, apply to china patent laws and regulations. 2. Because of the IP Centralization management, the employee invention remuneration's legal responsibility subject is the enterprise group, meanwhile the related members of group take the joint liability. 3. In employee invention remuneration's dispute even litigation, accordance with IP Centralization management, the distribution of the calculation of the amount of money and the burden of proof must be reasonable. We think take the heavier burden of proof to the enterprise group who has more information and materials is a better choice.
