摘要
在劳务派遣关系中,职务发明的权利归属和利益分配由发明人和所在单位双方的冲突变成了发明人、派遣机构、要派机构三方博弈的情形,导致了法律适用上的困境。而且,专利法与劳动法的不同立法取向进一步加剧了这一难题。因此,有必要对职务发明制度予以调整,一方面重构职务发明的权利归属规则,保障各方的合法权益,另一方面完善职务发明的利益分配模式,激发各方创新积极性。
In labor dispatch, the conflict between inventors and employers of rights ownership and benefits sharing of employee inventions changes into the controversy among inventors, employers who dispatch employees and employers who accept employees, which lead to a dilemma in application of law. Meanwhile, different legislative orientation between Patent Law and Labor Law aggravate the dilemma. Thus, it is necessary to adjust the system of service invention: on one hand, reestablish the regulation of rights ownership in employee inventions to protect the legitimate rights and interests of all parts; on another hand, perfect the model of benefits sharing in employee inventions to inspire the innovation enthusiasm of all parts.
