摘要
随着数字化时代的到来,读者对数字图书的阅读需求日益增长,促使图书馆加大数字图书的采购力度,扩大数字馆藏规模。然而在利用数字图书为读者提供服务时,图书馆欲要适用《信息网络传播权保护条例》规定的合理使用条款,即不需经著作权人同意也不需向著作权人支付报酬,则需要同时满足以下三个条件:服务对象是限定的、数字图书有合法来源、没有获得经济利益。
As the digital age approaches, an increasing number of readers are eager to read digital books, prompting libraries to spend more on digital books and expand their digital collections. However, in offering service to readers with its digital books, a library should satisfy the three requirements： restrictive serving objects, legally acquired digital books and no economic benefits gained, when it wants to qualify for the doctrine of fair use stipulated by Copyright Law, i.e., no need to get consent from and give remuneration to the copyright owner.
