摘要
当前,农村宅基地流转是由政府主导的,包括宅基地换房、保障房建设和地票交易等模式,其本质是政府"采购"宅基地。这种行为固然能提高容积率,解决集约使用的问题,但是不合理,因为在没有交易市场的前提下,宅基地是"无价"的,买方垄断的政府"采购"行为,极易形成"掠夺之手"。研究结论:通过扩大宅基地的用益物权,改革户籍制度,引入市场机制,能够保障农民"住房财产权",让农民分享城市化的级差收益。
Currently, the circulation of homestead land use right is dominated by the government, including the homestead wards,protection of housing construction and vote trading. Its nature is government's "procurement" of homestead. This behavior can increase the floor area ratio of course, solve the problem of intensive use. But it's unreasonable, because there is no market in the premise, the homestead was "priceless", the monopoly of government's "procurement" behavior can easily form "grabbing hand". Conclusions: by expanding the homestead usufruct, reform the household registration system, the introduction of market mechanisms to protect farmers' housing property ", so that farmers share earnings differential urbanization.
