法治政府建设的地方程序立法推进——制定《北京市行政程序条例》的几个问题

Moving Forward the Construction of Government under the Rule of Law through Local Procedure Legislation:Some Issues on Drafting Regulation on Administrative Procedure of Beijing

全面推进依法治国时代背景之下,法治政府建设的内容扩展和程序主义进路的确立提出了完善行政程序立法的要求。程序立法延续单行立法思路难以满足新的社会条件下法治政府建设的任务与要求,需要转向制定综合性统一行政程序立法。我国已经制定十二部地方行政程序规定,均以政府规章和行政规范性文件的形式出现,北京市首次尝试以制定地方性法规的方式完善统一行政程序立法,如果立法成功,将实现政府立法到人大立法的突破,意义重大。制定《北京市行政程序条例》的目的包括保障公民权利和提升行政效能,内容定位要针对北京行政管理存在的问题,回应党的十八届四中全会决定关于法治政府建设的基本思路与制度建构要求,程序制度构建应契合现代行政权力运行机制的基本要求,推动北京实现行政管理向公共治理的现代转型。

Under the background of comprehensively implementing governing the country by law,content expansion and procedure route establishment of the construction of government under the rule of law raise a new requirement to perfect administrative procedure legislation.In the new social conditions,continuing the individual procedure legislation mode will be difficult to meet the need of the construction of government under the rule of law.China should enact uniform procedure legislation instead.Now all twelve local administrative procedure legislations are local government rules or administrative documents.For the first time,the People＇ s Congress of Beijing City tries to enact local law and regulation to perfect administrative legislation.If it succeeds,China will achieve a breakthrough from the local government legislation to local people＇s congress legislation.Aims of enacting Regulation on Administrative Procedure of Beijing include safeguarding the rights of citizen and enhancing administrative efficiency.The regulation should respond to requirements of the construction of government under the rule of law raised by the Decision on a Number of Important Issues in Relation to Comprehensively Implementing Governing the Country by Law and resolve the problems existing in administrative management of Beijing.The procedure systems stipulated by the regulation should meet the basic demands of modern administrative power operation mechanism and it also should push on Beijing successful modern transformation from administrative government to public governance.
