论人权普遍定期审议机制的补充性及我国的应对

联合国人权理事会的人权普遍定期审议机制将"补充性"作为原则之一确定下来,明确其工作是对人权条约工作机构的补充而非重复。"补充性"既确立了普遍定期审议的定位,同时也因内涵尚不够清晰而给审议本身带来一定的困惑和不利。"补充性"的进一步明确有待国际人权审查机制的发展和完善。当前人权普遍定期审议的"补充性"特点给中国的人权事业带来的挑战和机遇并存,中国总体上应通过与该机制积极配合,参与和引领国际人权事务,推进国内人权发展。

The human rights universal periodic review（UPR） of United Nations Human Rights Council take the ＂complementary＂ as a basic principle,clear cut its complementary for the working mechanism of human rights treaties,not the repetition.The ＂complementary＂ establish the status of the UPR,it also make confuse and disadvantage for its fuzzy connotation.The further clarify for ＂complementary＂ need a further development and perfect of the UPR.The current characteristics of the UPR make both opportunities and challenges for China＇ s human rights cause.China should cooperative actively with the UPR,participate in and lead the international human rights affairs,Promote the development of domestic human rights cause.
