摘要
立案登记制是2014年我国《行政诉讼法》修改的最大亮点之一,但因《行政诉讼法》又将原告资格作为起诉条件之一,这种规定是否会消解立案登记所带来的积极作用,需要对此作出审慎分析。在立案登记制下,应当区分原告与正当原告,从形式意义上来理解原告。同时,在原告资格的认定上,应当恪守"主观诉讼"原则,坚持"合法权益"要素和"规范保护理论"。至于对原告资格等实体性起诉条件的审查,法院不妨采用诉讼化的程序。
The Registration of Acceptance is one of the biggest bright spot in " Administrative Procedure Law"(2014 Amendment),but because Standing in Administrative Litigation is one of the conditions for filing a complaint in the new Administrative Procedure Law,such provisions would dispel positive effect brought by the registration of acceptance,and we should make an prudent analysis.In the registration of acceptance,we should distinguish between procedural plaintiff and proper plaintiff,and define the concept of the plaintiff from the form meaning.On the plaintiff qualification of judgment,we should abide by the "subjective litigation" principle,adhere to the " legitimate interests" elements and " normative protection theory".As for the examination for the plaintiff qualification,the court may wish to adopt the lawsuit procedure.
