摘要
集体经营性建设用地流转所面临的法律困境主要表现在:集体经营性建设用地"使用权"未获正名;集体经营性建设用地使用权流转未得到一般性承认;"小产权房"屡禁不绝,行政、司法无能为力。集体经营性建设用地流转的制度障碍,源于《宪法》第10条"城市土地属于国家所有"之规定及其体系效应。为了实现集体经营性建设用地"同等入市"的改革目标,应在总结地方改革试点经验的基础上实行法制革新,包括:明确"集体建设用地使用权"的用益物权地位;排除集体经营性建设用地(使用权)流转的宪法和法律障碍;构建集体经营性建设用地使用权流转的规则体系;完善集体经营性建设用地使用权流转的配套制度。
A series of problems in the transfer of collective operational construction land have been a focus of public concern. Right of use to collective operational construction land doesnot get legal recognition, the transfer of which also hasn' t been general admitted. Furthermore, " small property house" blossom everywhere, with which government and judiciary have little help. The obstacle comes from article 10 of the Constitution, which stipulates that "urban land is owned by the state". In order to make the collective operational construction land flowing freely, there are several steps, which come from local experience, to follow: conforming to the status of collective operational construction land' s usufruct; removing the legal obstacles of transfer of collective operational construction land; and constructing the system of transfer; improving the relevant rules and regulations.
