摘要
"专车"现象本质上是共享经济的一种类型,它对传统出租车行业造成了巨大冲击。国内外政府对"专车"的态度不一,传统出租车行业对其强烈抵制。但是,"专车"作为共享经济的一种类型有很大发展前途,不应该禁止。通过建立混合规制模式,可以扬长避短,社会和消费者可以得到更多福利,地方政府可借以推进社会财富再分配和社会公共服务的市场化。混合规制模式是由"合作监管+自律监管"构成,地方政府在其中具有特殊的重要性,这是由共享经济运行机制和共享公司法律结构决定的。
In essence, the "specialcar" phenomenon is a type of sharing economy, which has caused great impact to the traditional taxi industry. There are several attitudes to the "special car" among the domestic and foreign governments. The traditional taxi industry resisted strongly to it. However, the "special car" has a shine future, and cannot be banned. The mixed regulation mode fits the Sharing economy, So that the society and consumers can get more benefits. At the same time, local governments can promote redistribution of social wealth and social public service. The mixed regulation ,node is composed of "cooperative regulatory and self-regu!atory", which is determined by the operating mechanism of Sharing economy and the legal structure of the Sharing company. Local governments are important roles to the mode.
