对于夫妻间由于琐事引起争吵导致一方自杀,另一方见死不救,导致自杀者死亡的案件,我国法院的判决逐渐表现出处罚不救助者的倾向。夫妻间的救助义务能否成为并且如何成为刑法上的救助义务,在我国理论界存在诸多观点。

With regard to the suicide caused by trivial matters between husband and wife, either of them turning a blind eye to the oth-er, the court of justice is increasingly inclined to penalize the one who folds his or her hands and sees the spouse to die.There are vari-ous views on whether the salvation obligation between conjugal relationships would be and how it would be a penal obligation in the criminal law.
