女权主义运动兴起于追求女性权利和实现男女平等的目标,现代社会普遍认为女性已经享有同男性平等的法律权利,批判者认为女权主义已经失去了持续存在的意义,但这样的平等似乎将女性发展引入歧途,平等与差异的争论是女权主义跳不出的魔咒。在后现代的批判下,当前的女性法律研究显示了"新女权主义"的发展潮流,赋予了女权主义新的时代意义。中国的女权主义思潮有着完全不同于西方的发展轨迹,特殊的社会历史背景深刻的影响到女权主义在中国的发展进程,新女权主义在中国有着不同的境遇。

The movement of feminist was arising in the pursuit of women’s rights,achieving the goal of equality between men and women. In modern society it is generally believed that women are already enjoying equal legal rights with men,but critics believed that feminism has lost the value of continuing to exist. The women seem to be led astray by the debate of equality and difference which is the spell of feminism can’t to jump out. In postmodern criticism,the current women’s legal researches indicate the new trend of feminism,which endows a new era meaning. China feminist thoughts are completely different from the western trajectory. The special social and historical background has profoundly influenced on feminism in China’s development process,so the neo- feminism in China has a different situation.
